Terms of Service

These Terms of Service ("Terms") govern your use of Cardboard Terminal (the "Service"), operated by the owner of cardboardterminal.app ("we", "us"). By creating an account, signing in, or using the Service, you agree to these Terms, including the arbitration agreement and class action waiver in Section 15. If you do not agree, do not use the Service.

The short version. Cardboard Terminal is a data tool, not an adviser. Every number we show is an automated estimate that can be wrong or stale. Nothing here is a recommendation to buy, sell, or bid on anything. If you trade based on what you see here, that decision and every dollar of its outcome is yours alone.

1. What the Service is

Cardboard Terminal aggregates publicly available information about live and recently ended online auctions for graded trading cards and displays estimated market values and statistics derived from recent sales data. The Service is an informational tool only.

2. No investment, financial, or purchasing advice

We are not an investment adviser, broker-dealer, commodity trading adviser, financial planner, appraiser, or fiduciary, and we are not registered with any financial regulator. No fiduciary, advisory, or professional relationship is created by your use of the Service. Nothing in the Service constitutes investment advice, financial advice, trading advice, an appraisal, or a recommendation or solicitation to buy, sell, bid on, hold, or refrain from any transaction in any item or asset.

This applies to everything we publish, including: the Deal Finder and its "vs value" percentages; the Command Center (market gauge, tiles, Sales Screener, momentum "heating up" and "cooling off" lists, money-flow, set and era tables); Trends pages and indexes; card pages, price charts, expected values, medians, and momentum figures; any alerts or emails; and any content we post on social media or elsewhere. All of it is automated statistical output provided for information only.

3. Assumption of risk

Collectibles and trading cards are speculative, volatile, and often illiquid. Prices can fall as fast as they rise; grading outcomes are subjective; past prices do not predict future prices; and an item may be unsellable at any price. YOU ACKNOWLEDGE AND AGREE THAT ANY DECISION TO BUY, SELL, BID, OR HOLD IS MADE SOLELY BY YOU, AT YOUR OWN RISK, AND THAT YOU MAY LOSE SOME OR ALL OF ANY AMOUNT YOU SPEND. You are responsible for your own research and for consulting licensed professionals (financial, tax, legal) before making decisions with financial consequences. WE ACCEPT NO RESPONSIBILITY OR LIABILITY FOR ANY TRADING OR PURCHASING OUTCOME.

Cardboard Terminal is not affiliated with, endorsed by, or sponsored by eBay Inc., Professional Sports Authenticator (PSA), Collectors Universe, The Pokémon Company, Nintendo, or any marketplace, grading company, or brand referenced in the Service. All trademarks belong to their respective owners. Auction listings shown link to third-party marketplaces; your dealings with those marketplaces and their sellers are governed by their own terms and are solely between you and them. You release us from any claim arising out of your dealings with any third-party marketplace, seller, or grader.

8. Changes to, or discontinuation of, the Service

We may change, suspend, or improve the Service, or any feature of it, at any time.

Right to discontinue. We may discontinue the Service permanently, in whole or in part, at any time and for any reason. If we permanently discontinue the Service: (a) we will immediately stop selling new subscriptions and stop charging renewals; and (b) each active subscriber will, at our option, either (i) retain access to the Service (or the remaining portion of it) through the end of the billing period they have already paid for, or (ii) receive a refund of the prepaid fees covering the unused remainder of their current billing period. Completing (a) and (b) fully satisfies our obligations to subscribers in connection with discontinuation, and no further compensation or damages will be owed.

9. Acceptable use

We may suspend or terminate accounts that violate these Terms, without refund for the current billing period.

10. Intellectual property

The Service, including its software, design, compiled data, and value estimates, is our property or licensed to us. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial purposes while you have an active account in good standing.

11. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA OR OUTPUT (INCLUDING PRICES, BID COUNTS, VALUE ESTIMATES, SCREENERS, INDEXES, MOMENTUM FIGURES, OR ANY OTHER SIGNAL) WILL BE ACCURATE, COMPLETE, OR CURRENT.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA; (B) WE WILL NOT BE LIABLE FOR ANY TRADING, BIDDING, PURCHASING, OR SELLING LOSSES OF ANY KIND, WHETHER OR NOT BASED ON INFORMATION SHOWN IN THE SERVICE, EVEN IF THAT INFORMATION WAS INACCURATE, DELAYED, OR INCOMPLETE, AND EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH LOSSES; AND (C) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE. THE DISCLAIMERS AND LIMITS IN SECTIONS 2, 3, 4, 11, AND 12 ARE A FUNDAMENTAL BASIS OF THE BARGAIN BETWEEN YOU AND US; THE SERVICE WOULD NOT BE OFFERED AT ITS PRICE WITHOUT THEM.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your trading or purchasing decisions, or your violation of these Terms.

14. Time limit on claims

To the extent permitted by law, any claim arising out of or relating to the Service must be filed within ONE (1) YEAR after the claim arose, or it is permanently barred.

15. Dispute resolution: arbitration and class action waiver

Informal resolution first. Before filing any claim, you agree to contact us at support@cardboardterminal.app and give us 30 days to resolve the dispute informally.

Binding arbitration. Any dispute not resolved informally will be resolved by final, binding arbitration on an individual basis, administered by JAMS under its Streamlined Arbitration Rules (or, if JAMS is unavailable, the American Arbitration Association under its Consumer Arbitration Rules), rather than in court. The arbitration will be conducted in English, by a single arbitrator, with any hearing held remotely or in the county where you reside. Either party may instead bring an individual claim in small claims court.

CLASS ACTION AND JURY WAIVER. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING. CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY.

Opt-out. You may opt out of this arbitration agreement by emailing support@cardboardterminal.app within 30 days of first accepting these Terms, stating your account email and your intent to opt out of arbitration. Opting out does not affect any other part of these Terms.

Either party may seek injunctive relief in court for infringement or misuse of intellectual property or for unauthorized access to the Service.

16. Changes to these Terms

We may update these Terms from time to time. The current version will always be available at this page with its effective date. Material changes will be reflected here; your continued use of the Service after changes take effect constitutes acceptance.

17. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Subject to Section 15, any disputes not subject to arbitration will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
